Primary Management Official means:

  1. The person(s) having management responsibility over all or any part of any gaming operation;

  2. Any person who has authority:

    1. To hire and fire employees of a gaming operation; or

    2. To establish working policy for a gaming operation;

  3. The chief financial officer or other person who has financial management responsibility for any gaming operation;

  4. Any person who is a controlling shareholder of a management contractor; or

  5. Any equivalent position in a gaming operation that the Commission designates by its rules as a primary management official.

Key Employee means:

  1. A person who performs one or more of the following functions:

    1. Bingo Caller

    2. Count Room Supervisor

    3. Chief of Security

    4. Custodian of Gaming Supplies or Cash

    5. Floor Manager

    6. Pit Boss

    7. Dealer

    8. Croupier

    9. Approver of Credit

    10. Custodian of gambling terminals or other devices operated by the management of any gaming operation, including persons with access to cash and accounting records for such devices

    11. If not otherwise included, any other person whose total cash compensation from employment in any gaming operation exceed $50,000.00 per year;

  2. If not otherwise included, the four most highly compensated persons in any gaming operation; or Any person who is a controlling shareholder of a management contractor; or

  3. Any equivalent position in a gaming operation that the Commission designates by its rules as a key employee

Gaming Vendor -

Vendors who manufacture, supply, distribute, provide service or repair to the following products utilized in the conduct of Gaming Activities:

  1. Gaming Devices

  2. Electronic Table Games

  3. Gaming Tokens

  4. Gaming Chips

  5. Drop Boxes

  6. Cash Handling / Counting Equipment

  7. Coinage Handling / Counting Equipment

  8. Bill Validators

  9. Coin Comparitors

  10. Gaming Monitoring Systems

  11. Customer Monitoring Systems

  12. Surveillance Systems

  13. Other Vendors who are a manufacturer, supplier, distributor, provides service or repair of other devices utilized in conjunction with Gaming Activities that have been determined by the Executive Director of the Cherokee Tribal Gaming Commission as warranting a Gaming Vendor classification for purposes of license in the jurisdiction.

  14. Vendors who are parts distributors that only provide repair parts for Gaming Equipment or Cash Handling Equipment     SHALL BE classified as either a Minor or Major Vendor depending upon the revenue thresholds contained therein.  This exemption from the Gaming Vendor category precludes a parts distributor from selling Gaming Equipment. Should the parts distributor provide new Gaming Equipment or original Cash Handling Equipment then they SHALL apply and be licensed as a Gaming Vendor under these regulations.If not otherwise included, the four most highly compensated persons in any gaming operation; or Any person who is a controlling shareholder of a management contractor; or

  15. Any equivalent position in a gaming operation that the Commission designates by its rules as a key employee

Vendors who exceed gross payments from the Casino Enterprise in excess of $300,000.00 (Three-Hundred Thousand Dollars) within a fiscal year OR Vendors that would require access to a Secured Area within the Casino Complex as defined by the Cherokee Tribal Gaming Commission.

Vendors that receive gross payments from the Casino Enterprise in excess of $50,000.00 (Fifty Thousand Dollars) but NOT more than $300,000.00 (Three-Hundred Thousand Dollars) within a fiscal year OR Vendors that conduct business “on-property”.

Vendors and the following business “types” that conduct business within the fiscal year that DO NOT receive gross payments from the Casino Enterprise in excess of $50,000.00 (Fifty Thousand Dollars) AND DO NOT conduct business “on-property”, SHALL BE treated as an Exempt Vendor:

  1. Public Utilities regulated by the Eastern Band of Cherokee Indians or the State of North Carolina

  2. Hotels, Motels, or other Lodging Facilities located within the State of North Carolina

  3. Professional entertainers, sports figures, and other celebrities engaged by a licensed Gaming Facility to appear at casino-sponsored special entertainment or promotional events

  4. Large Retail Chain Stores (Wal-Mart)

  5. Medical corporations, partnerships, or sole proprietorships, where the officers, directors, and owners are physicians licensed in North Carolina

  6. North Carolina or Federally Certified Educational Institutions

  7. Attorneys licensed to practice law by the Eastern Band of Cherokee Indians or the State of North Carolina, including legal partnerships and legal professional corporations

  8. Accountants/Auditors licensed to practice by the Eastern Band of Cherokee Indians or the State of North Carolina

  9. Major Newsprint Media Purveyors

  10. FCC Regulated Broadcast Media Purveyors (Radio / Television)

  11. Agencies of Federal, State, or Tribal Government

  12. Insurance Companies licensed to transact business by the Eastern Band of Cherokee Indians or the State of North Carolina

  13. Any other vendor who has received an approved exemption, in writing, from the Executive Director of the Cherokee Tribal Gaming Commission
